Does every legal entity need a workplace risk assessment?

No, only those legal entities that are employers – meaning those who employ at least one person who is not a member of the management, owner, etc. It doesn't matter whether you are a company, sole proprietorship, school, association, etc. All legal entities that are employers are required to take care of occupational safety and health.

How long is a workplace risk assessment valid?

Once a workplace risk assessment is done, it is permanent. However, the assessment must always be up-to-date. This means that the assessment needs to be periodically updated based on the following circumstances: changes in existing locations or the opening of new ones, the introduction of new job positions, the introduction of new work processes and technologies, the hiring of new personnel, etc.

We had a risk assessment for a j.d.o.o., and now we are a d.o.o. – do we need to create a new risk assessment?

If everything else remains the same and the existing d.o.o. is the successor to the j.d.o.o. (meaning the employees are the same, work processes are the same, locations are the same), there is no need for a new risk assessment.

2Legal obligations

An employer is obliged, taking into account the tasks and their nature, to assess risks to the life and health of workers and persons at work, especially regarding work equipment, the work environment, technology, physical hazards, chemicals, or biological agents used, the organization of the workplace, the organization of work processes, the monotony of work, static and psychophysiological stress, work with imposed rhythm, work according to performance in a set time (standardized work), night work, mental workload, and other present risks, for the purpose of preventing or reducing risks.

Risk assessments can be carried out by authorized persons or by the employer for their own needs. In the process of risk assessment, the person conducting it (authorized person or the employer themselves) and workers or their representative (workers' trustee) participate. The risk assessment process consists of:

  • collecting data at the workplace
  • analyzing and assessing collected data, which includes identifying hazards, harmful factors, and efforts; assessing hazards, harmful factors, and efforts; determining measures to eliminate or reduce the level of hazards, harmful factors, and efforts
  • a plan of measures to eliminate or reduce the level of hazards, harmful factors, and efforts, including deadlines, responsible persons for implementing the measures, and a method of monitoring the implementation of measures
  • documenting the risk assessment
