MINIMUM TECHNICAL CONDITIONS AND OCCUPATIONAL SAFETY

The main difference between minimum technical conditions and occupational safety is that you need to address minimum technical conditions before opening or starting operations, while occupational safety is typically addressed after the location where you work is operational. Additionally, ensuring occupational safety is an obligation for every employer, whereas minimum technical conditions only need to be addressed by legal entities in the following industries:

  • hospitality
  • tourist agencies
  • trade and services in trade
  • accommodation services

Since there may be procedural differences depending on the city, county, and so on, we will provide examples of the procedure related to the City of Zagreb.

Minimum Technical Conditions for Hospitality Establishments (Cafes, Restaurants, etc.) include the following:

  • Commercial Court registration decision (for legal entities) or Craft Register registration decision (for natural persons),
  • Evidence of the right to use the premises (land registry excerpt, purchase agreement, lease agreement, etc.),
  • Evidence that the building can be used, i.e., issuance of a decision to perform activities in accordance with the provisions of the Construction Act,
  • For buildings in the Historic Urban Zone of the City of Zagreb and for protected immovable cultural properties outside the historic urban zone: Prior approval from the City Institute for the Protection of Cultural and Natural Monuments (Kuševićeva 2) in accordance with Article 65 of the Cultural Heritage Protection and Preservation Act,
  • Report on the testing and safety of electrical installations,
  • Report on the testing and efficiency of ventilation systems,
  • Decision indicating that noise protection measures have been implemented, issued by the Ministry of Health (noise protection measures for hostels only),
  • Report on air pollution from harmful emissions for hospitality establishments that prepare and serve meals,
  • Evidence of the health safety of drinking water, if the hospitality establishment is opening for the first time or has not operated for more than 6 months,
  • Evidence of the impermeability of the water and sewage installations for hospitality establishments located in areas not connected to the public sewage network.

For requests to continue providing hospitality services in establishments that are not categorized, you must also submit a Commercial Court registration decision (for legal entities), Craft Register registration decision (for natural persons), evidence of the right to use the business premises, and a statement in accordance with Article 25, paragraph 3, of the Hospitality Industry Act. It's worth noting that the legislator has also issued a Regulation on Fire Protection in Hospitality Establishments, so we recommend reading that as well.


Minimum Technical Conditions for Tourist Agencies include:

  • A copy of the Commercial Court registration decision (for legal entities) or Craft Register registration decision (for natural persons) and the craft certificate,
  • Evidence of the right to use the premises (land registry excerpt, purchase agreement, lease agreement, etc.),
  • Evidence that the building can be used, i.e., issuance of a decision to perform activities in accordance with the provisions of the Construction Act,
  • Prior approval from the City Institute for the Protection of Cultural and Natural Monuments (Kuševićeva 2) in accordance with Article 65 of the Cultural Heritage Protection and Preservation Act - for buildings in the Historic Urban Zone of the City of Zagreb and for protected immovable cultural properties outside the historic urban zone,
  • Report on the testing and safety of electrical installations.

The branch manager must meet the following conditions:

  • Citizen of the Republic of Croatia or a citizen of a member state of the European Economic Area and the Swiss Confederation (or a citizen of third countries with the consent of the Ministry of Tourism),
  • Legally competent,
  • Has at least a high school education,
  • Actively speaks at least one world language and knows one more,
  • Has passed the professional examination for branch manager and has two years of work experience in appropriate jobs in a tourist agency or other relevant tourism jobs,
  • Has not been subject to a security measure or protective measure prohibiting the performance of branch manager duties by a legally binding court judgment or misdemeanor decision – while this measure is in effect.

Minimum Technical Conditions for Retail Businesses include:

  • Evidence of the right to use the premises (land registry excerpt, purchase agreement, lease agreement, etc.),
  • Copy of the Commercial Court registration decision (for legal entities) or Craft Register registration decision (for natural persons),
  • Evidence that the building can be used, i.e., issuance of a decision to perform activities in accordance with the provisions of the Construction Act,
  • Prior approval from the City Institute for the Protection of Cultural and Natural Monuments (Kuševićeva 2) in accordance with Article 65 of the Cultural Heritage Protection and Preservation Act - for buildings in the Historic Urban Zone of the City of Zagreb and for protected immovable cultural properties outside the historic urban zone,
  • Report on the testing and safety of electrical installations,
  • Other documents depending on the type of activity and the construction and equipment of the premises.

Minimum Technical Conditions for Accommodation Services – for legal entities:

  • Commercial Court registration decision (for legal entities) or Craft Register registration decision (for natural persons),
  • Evidence of the right to use the business premises (for accommodation facilities – rooms, apartments, studio apartments, and vacation houses allowed for residential purposes),
  • Evidence that the building can be used, i.e., issuance of a decision to perform activities in accordance with the provisions of the Construction Act,
  • For buildings in the Historic Urban Zone of the City of Zagreb and for protected immovable cultural properties outside the historic urban zone: Prior approval from the City Institute for the Protection of Cultural and Natural Monuments (Kuševićeva 2),
  • Graphic representation of the accommodation facility,
  • Decision from the Ministry of Health, Health Improvement Administration, County Sanitary Inspection and Legal Support Department, Department for the City of Zagreb, Zagreb, Ksaver 200a, confirming compliance with noise protection requirements (for hostels only),
  • Report on the testing and safety of electrical installations,
  • Report on the impermeability of gas installations and gas appliances,
  • Report on the hygienic safety of drinking water (if necessary),
  • Administrative fee of HRK 20.00 upon submission of the application, and the remainder of HRK 70.00 is paid to bank account number HR3423600001813300007, reference number: HR68 5703-OIB, in favor of the City of Zagreb Budget, amount: _______ kuna, purpose: administrative fee – accommodation services, payable upon approval of the request.

Minimum Technical Conditions for Accommodation Services – for natural persons:

Each of these activities has specific requirements related to minimum technical conditions. Note that reports (certificates) of inspections in the premises (electrical installations, gas, etc.) are carried out by companies authorized for specific types of testing, and you may not find a single company that can provide all the required tests. Also, keep in mind that when you start operating, you will need to create evacuation plans for your premises.
