27. October 2020.ORDINANCE ON THE CONDITIONS TO BE MET BY LEGAL AND NATURAL PERSONS PERFORMING THE ACTIVITY OF COMPULSORY DISINFECTION, DISINSECTION AND PEST CONTROL AS MEASURES FOR THE PREVENTION AND CONTROL OF INFECTIOUS DISEASES OF THE POPULATION
I. GENERAL PROVISIONS
Article 1.
This Ordinance lays down the conditions regarding the professional qualifications of workers, technical equipment, premises and other conditions that must be met by health institutions, other legal entities and persons who independently perform the activity of mandatory disinfection, disinsection and pest control (hereinafter: DDD measures).
The provisions of this Ordinance also lay down the conditions regarding the professional qualifications of workers, technical equipment, premises and other conditions that must be met by health institutions performing the anti-epidemic DDD measure as a special measure (hereinafter: anti-epidemic DDD measure).
Article 2.
The mandatory DDD measure can be carried out by health institutions and other legal entities and persons who independently perform personal activities, if they have the approval of the minister responsible for health for the performance of this activity.
Authorisation to carry out a mandatory DDD measure involving the use of highly toxic (T+) and methyl bromide chemicals shall be granted for a period of three years.
Authorisation to carry out a mandatory DDD measure involving the use of toxic (T), Harmful (Xn), Irritant (Xi), Corrosive (C) and other hazardous chemicals with the exception of methyl bromide shall be granted for a term of five years.
Article 3.
When the sanitary inspection of the ministry responsible for health, by inspection supervision, determines that the health institution and other legal entity and the person who independently performs his personal activity does not perform the mandatory DDD measure in accordance with the approval referred to in the Article Item 2 2. and 3 of this Regulation, the authorisation to perform the mandatory DDD measure shall be revoked even before the expiry of the time to which it has been granted.
II. MANDATORY DISINFECTION, DISINFECTION AND PEST CONTROL
Article 4.
The marketing authorisation holder referred to in Article 2 item 2 this Regulation must employ in a full-time employment relationship at least:
– one doctor of medicine,
– one sanitary engineer,
– four sanitary technicians.
Article 5.
Marketing Authorisation Holder referred to in article Item 2 3. this Regulation shall employ in a full-time employment relationship at least:
– one graduated sanitary engineer or graduate biology engineer or biology professor or doctor of medicine,
– one sanitary engineer,
– two sanitary technicians.
Article 6.
Responsible person of the marketing authorisation holder referred to in Article 2. item 2 This rule is a doctor of medicine.
Responsible person of the marketing authorisation holder referred to in the Article Item 2 3. this Regulation is a graduate diagnostic engineer or a graduate engineer of biology or a professor of biology or a doctor of medicine.
Responsible persons for the implementation of mandatory DDD measures and all contractors of mandatory DDD measures must have passed a course on the use of chemicals in accordance with special regulations and must be continuously professionally trained (Permanent education for contractors of mandatory DDD measures in accordance with Article 16 of this Regulation).
Article 7.
Conditions regarding the equipment for granting authorisationreferred to in Article 2. item 2 These regulations are:
1. Work equipment:
– 2 warm fogging devices with a capacity of 5 liters,
– 1 device for cold molding – aerosol generator,
– 4 back motor sprayers with dusting and granulating accessories,
– 1 pressure sprayer with safety valve for each contractor of mandatory DDD measures,
– 1 gas detection device with a sufficient number of corresponding indicator tubes or sensors for fumigants used in operation,
– appropriate accessories for the application of fumigants (opener for specific fumigant, dispenser and evaporiser depending on the type of gas they apply).
2. personal protective equipment for each contractor of mandatory DDD measures consisting of: rubber boots, chemical-resistant rubber or leather gloves, a sufficient quantity of disposable gloves, protective overalls, coat or robe, face shield or goggles, caps and helmets, protective agents for the protection of the hearing organs.
3. special protective equipment according to the type of work performed by:
– 1 full face mask (HRN EN 136) for each contractor who is allowed to work with chemicals with the sign Very Toxic (T+) and methyl bromide,
– a sufficient quantity of gas filters (HRN EN 141), prescribed and adapted to the physico-chemical properties of a particular gas,
– at least three stand-alone breathing devices with an open compressed air circuit (HRN EN 137) or with a closed circuit (HRN EN 145).
4. a first aid kit equipped in accordance with special regulations with basic symptomatic drugs in case of poisoning, which must always be with the person responsible for working with chemicals,
5. instructions for the application of first medical aid in case of poisoning that each team of contractors of mandatory DDD measures must possess during the implementation of the measures.
Article 8.
The marketing authorisation holder referred to in Article 2 item 2 this Ordinance must have its own business and storage space in accordance with special regulations.
Storage space referred to in paragraph 1. This article must have:
1. a room for the accommodation, storage and dispensing of chemicals with the sign Very Toxic (T+) and methyl bromide, with an area of at least 10 m2,
2. storage room for technical equipment and apparatus for application, with an area of at least 15 m2,
3. a wardrobe room with two wardrobe cabinets with a padlock or key for each warehouse worker (one for work clothes and personal protective equipment, and the other for personal wardrobe),
4. sanitary facilities with shower and fountain or faucet with flexible hose for rinsing the eyes.
Article 9.
Conditions regarding the equipment for granting the authorisation referred to in article Item 2 3 of this Regulation are:
1. Work equipment:
– 1 pressure sprayer with safety valve for each contractor of mandatory DDD measure,
– 2 dorsal motor sprayers with accessories for spraying, dusting and granulating,
– 1 cold dew apparatus – aerosol generator,
– 1 warm blur with a capacity of 5 liters.
2. personal protective equipment for each contractor of mandatory DDD measures consisting of: rubber boots, rubber or leather gloves resistant to chemicals, a sufficient quantity of disposable gloves, protective overalls, coat or robe, face shield or protective glasses, caps and helmets, protective agents for the protection of the hearing organs.
3. special protective equipment according to the type of work carried out, for each contractor mandatory DDD measures:
– filter half masks (disposable or reusable) intended to stop dry aerosols (dusty) in quantity depending on the number of employees,
– 1 filter half mask (HRN EN 149) or filter half mask (HRN EN 1827) with particle protection filters (HRN EN 143),
– 1 full face mask (HRN EN 136) with combined filters for protection against gases and particulate matter (HRN EN 141),
4. a first aid kit equipped in accordance with special regulations with basic symptomatic drugs in case of poisoning, which must always be with the person responsible for working with chemicals,
5. instructions for the application of first medical aid in case of poisoning that each team of contractors of mandatory DDD measures must possess during the implementation of the measures.
Article 10
Marketing Authorisation Holder referred to in article Item 2 3. this Regulation must have its own business and storage space in accordance with special regulations.
Storage space referred to in paragraph 1. This article must have:
1. a room for the accommodation, storage and dispensing of chemicals with the sign Toxic (T), Harmful (Xn), Irritants (Xi), Corrosive (C) and other hazardous chemicals with the exception of methyl bromide with the surface of at least 15 m2,
2. storage room for technical equipment, apparatus for the application of surfaces of at least 15 m2
3. a wardrobe room with two wardrobe cabinets with a padlock or key for each warehouse worker (one for work clothes and personal protective equipment, and the other for personal wardrobe),
4. sanitary facilities with shower and fountain or faucet with flexible hose for rinsing the eyes.
If the storage space is separated from the office premises, the storage space must also have a separate room for workers.
Article 11
Approval to perform mandatory DDD measure by the method of fumigation with highly toxic and hazardous chemicals is issued for a specific chemical with a certain maximum amount that may be stored on the basis of the opinion of the Croatian Institute of Toxicology.
Article 12
Premises for the storage, storage and dispensing of chemicals referred to in Article 8 and 10. these Regulations must be built of solid material which, by the finding of the competent authority, has been determined to be in accordance with sanitary-technical and hygienic conditions in terms of location, construction method, quality of walls and floors, illumination, ventilation, temperature and humidity, in accordance with special regulations.
The room for the storage, storage and dispensing of chemicals must have a sufficient number of cabinets or shelves, which will house chemicals, ensured stability to prevent mechanical or other damage to individual packaging.
Premises for the storage, storage and dispensing of chemicals must be under lock and key. On the front door to the room must be displayed signs prohibiting access to unauthorized persons and the type of chemical that are stored in the room. Labels of the type of chemicals that are stored must be displayed on cabinets or shelves. In visible places in the room must be marked on the prohibition of smoking, taking food and beverages, written instructions on the treatment of exposure to chemicals, warning and notification labels, telephone numbers of responsible persons and accident services, direction of movement in the event of fire or other chemical accidents. In the room for accommodation, storage and dispensing of chemicals must be at least 1 fire extinguisher.
Equipment for work referred to in Article 7 item 1 and Article 9. item 1 this Regulation must be correct in accordance with special regulations.
A health institution and other legal entity and a person who independently implements DDD measures by personal work is obliged to submit an application for determining and assessing the risk of harm to health at the workplace and in the working environment to an authorized institution or company registered to perform occupational safety and safety.
III. MANDATORY ANTI-EPIDEMIC DISINFECTION, DISINSECTION AND PEST CONTROL
Article 13
Health institutions that perform the activity of mandatory anti-epidemic DDD measures must employ in employment with a full-time doctor of medicine, specialist in epidemiology.
Where a health institution implements a mandatory anti-epidemic DDD measure involving the use of highly toxic (T+) and methyl bromide chemicals, it shall comply with the conditions laid down in Articles 4, 6, 7, 8, 11. 12 of this Regulation.
Where a health institution implements a mandatory anti-epidemic DDD measure involving the use of toxic (T), Harmful (Xn), Irritant (Xi), Corrosive (C) and other hazardous chemicals with the exception of methyl bromide, it shall comply with the conditions laid down in Article 5, 6. item 2 and 3rd, 9th, 10th and 12. this rule.
IV. DOCUMENTS REQUIRED TO GRANT AUTHORIZATION TO PERFORM DDD MEASURES
Article 14
In addition to the application for authorisation referred to in the article Item 2 2. and 3. the following documentation must be attached:
– extract from the register of commercial courts,
– a decision of the competent authority for the use of chemicals,
– title deed or contract for the lease of premises for the storage of chemicals certified by a notary public,
– floor plan of business premises and chemical storage rooms,
– proof of ownership of the equipment referred to in Article 7 In other words, 9. this Rule,
– certificate of certified work equipment subject to attestation,
– list of workers (name, surname, professional qualifications),
– a copy of the work book of the responsible person and the contractor of DDD measures in accordance with this Regulation,
– a copy of the certificate of health checks of workers.
V. HEALTH CHECKS
Article 15
Workers who implement DDD measures are obliged to perform health checks before the start of the implementation of DDD measures, once a year during the implementation of DDD measures and after termination of employment in accordance with special regulations on safety at work.
Health check referred to in paragraph 1. this Article is carried out on the basis of a referral for determining the health capacity of workers (RA form – 1) issued by the employer.
The scope and type of health examination depends on the assessment of hazards in the workplace in accordance with special regulations.
A certificate of health fitness of workers for jobs with special working conditions (working with chemicals) is issued by a specialist in occupational medicine.
YOU. EDUCATION
Article 16
Responsible persons and all contractors of mandatory DDD measures are obliged to permanently improve (Permanent education for contractors of mandatory DDD measures).
Continuing education program referred to in paragraph 1. this article for contractors of mandatory DDD measures is adopted by the Minister responsible for health at the proposal of the Croatian Institute of Public Health.
VII. IDentification Cards
Article 17
Each contractor of mandatory DDD measures in employment with the marketing authorisation holder referred to in the Article Item 2 2. and 3. must have a plastic ized identification card, dimensions 110 x 80 mm,
IDentification card forms are printed in the Annex 1. and 2 of this Regulation which form an integral part thereof.
Identification card referred to in paragraph 1. this article must contain:
– name and address of the marketing authorisation holder for the implementation of DDD measures,
– photo of the contractor of the DDD measure size 25 x 35 mm,
– name and surname of the contractor of DDD measures and the number of his identity card,
– class, registration number and date of authorisation to carry out DDD measures.

Framework of identification card of contractors of mandatory DDD measures with approval referred to in article Item 2 3. of this Regulation is orange.
VIII. RECORDS AND REPORTS
Article 18
The marketing authorisation holder is obliged to keep records of implemented DDD measures, pesticide consumption and to prepare summary reports and submit them in the manner and within the deadlines set by the Ordinance on the manner of performing mandatory disinfection, disinsection and pest control.
X. TRANSITIONAL AND FINAL PROVISIONS
Article 21
On any change referred to in Articles 4, 5, 7, 8, 9. and 10 of this Ordinance, authorisation holders are obliged to notify in writing to the competent sanitary inspection and sanitary inspection of the ministry responsible for health
Article 22
If the marketing authorisation holder ceases to carry out activities in accordance with the authorisation granted in the Article Item 2 2. and 3 of this Regulation is obliged to notify the ministry responsible for health in writing.
Article 23
Health institutions and other legal entities and persons who independently perform DDD measures are obliged to align their business with the provisions of this Ordinance no later than 90 days from the date of entry into force of this Ordinance.
Article 24
On the day of entry into force of this Ordinance, the Ordinance on the conditions to which legal and natural persons carrying out disinfection, disinsection and pest control must comply with as a measure for the prevention and control of infectious diseases of the population (“Official Gazette” no. 38/98) ceases to be valid.
Article 25
This Regulation shall enter into force on the eighth day following its publication in the “Official Gazette”.
