PART ONE
GENERAL PROVISIONS
Article 1.
(1) This Ordinance establishes the performance of inspections and tests of work equipment, the deadlines of inspections and tests, and the content and manner of issuing records of inspection and testing of work equipment.
(2) Inspection and testing of work equipment refers to work equipment consisting of machinery and appliances, installations and means of transporting and transporting goods under the regulation on safety and health in the use of work equipment.
(3) Inspection and testing of work equipment referred to in paragraph 2. this Article is carried out in order to verify the fulfilment of safety and health requirements on work equipment, i.e. to detect and eliminate deficiencies that could endanger the safety and health of operators or other workers in the area of use of work equipment.
Article 2.
For the purposes of this Regulation, it shall be deemed to be:
1) Review is a visual determination of the functionality of the work equipment in such a way that it does not endanger the safety and health of workers in its use, visual determination of the application of safety and health requirements according to the technical documentation of the manufacturer of work equipment, determination of the availability of instructions for operation and maintenance of work equipment and determination of the state of maintenance of work equipment according to the manufacturer’s instructions or according to recognized rules of safety at work.
(2) Examination is any other operation in a procedure which cannot be determined by the examination referred to in subparagraph 1. this Article, which is necessary for the establishment of certain safety and health requirements and is carried out using measuring and testing equipment.
Article 3.
(1) The provisions of this Regulation shall not apply to work equipment consisting of electrical and electronic products covered by the regulation on electrical equipment intended for use within certain voltage limits:
1. household appliances intended for use in the household
2. Audio and video equipment
3. Information technology equipment
4. Common office machines
5. low-voltage switching and control devices and
6. Electric motors.
(2) The provisions of this Regulation do not apply to manual work equipment (tools) and to scaffolding and other means of occasional work at a height for which inspections are carried out according to special regulations.
PART TWO
SPECIFICATION
Article 4.
Authorised persons may carry out inspections and tests of work equipment referred to in the Article Item 1 2. of this Ordinance if they have an authorization in accordance with the provisions of the regulations on authorizations for occupational safety and if they meet the technical requirements prescribed by this Ordinance.
Article 5.
(1) With the authorisation issued under Article 4. An authorized person shall own the measuring and test equipment listed in the Annex which is an integral part of this Regulation.
(2) In addition to the measuring and test equipment listed in the Annex to this Regulation, an authorized person may also have additional measuring and test equipment for specific tests owned or under a lease agreement.
Article 6.
(1) Measuring and test equipment referred to in Article 5. this Regulation must be kept and maintained in the manner indicated in the instructions of the manufacturer of the measuring and test equipment.
(2) Documentation shall be kept on the measurement and test equipment, which shall contain the following information:
– name of measuring and testing equipment
– manufacturer name
– type, model and serial number
– year of production
– year of putting into service
– date of last calibration and
– proof of ownership or lease (for accessories).
(3) The measuring and test equipment referred to in the Annex to this Regulation for which there is an obligation to calibrate, shall be calibrated in the manner and within the deadlines set by the regulations in metrology, i.e. according to the recommendation of the manufacturer.
PART THREE
DEADLINES FOR EXAMINATIONS AND EXAMINATIONS
Article 7.
An employer who is a user of work equipment listed in the article Item 1 2. of this Regulation, he shall ensure, in the prescribed manner, inspections and tests of working equipment in the following cases:
– before starting use at a new place of work, if the work equipment has been moved from one place to another and is therefore disassembled and reassembled
– in the case of exceptional circumstances that endanger the safety of work equipment (change of working mode, damage to work equipment, defects in work equipment, injuries to workers on work equipment)
– based on the decision of the labour inspector
– within the time limits set in the instructions for use and maintenance by the manufacturer of work equipment, or within a time limit laid down in a special regulation, or
– periodically within time limits that cannot exceed three years.
PART FOUR
EXAMINATION AND TESTING PROCEDURE AND CONTENT AND MANNER OF ISSUING RECORDS OF INSPECTION AND TESTING OF WORK EQUIPMENT
Article 8.
An authorised person performing inspections and tests of work equipment shall keep records of all subjects of examination and testing, of the procedures and conditions of examination and testing, of the results of inspections and tests, and of the measuring and test equipment used in the test.
Article 9.
During the verification and assessment of compliance with safety and health requirements on working equipment, the manufacturer’s instructions for use and maintenance, the requirements of safety and health regulations when using work equipment, the requirements of the safety regulations on machinery when putting them into service and the corresponding Croatian standards are used.
Article 10
(1) A record shall be drawn up of the inspection and testing of the work equipment containing at least the following information:
1. name and seat and OIB of the user of work equipment
2. name and seat and OIB of an authorised person performing inspection and testing of work equipment
3. the number of minutes and the date of preparation
4. number and date of issuance of the decision on the authorization to perform inspections and testing of work equipment
5. the names of the regulations establishing the obligation to test work equipment
6. the names of the regulations according to whose requirements the verification of compliance with the safety and health requirements on the work equipment has been carried out
7. data specifying the working equipment (type, model, manufacturer’s name, tv number), with a description of the purpose and position of the work equipment in the workspace
8. basic information on refrigerants and raw materials used in work
9. indications of risks to the safety and health of workers when using work equipment
10. name and surname, OIB and professional qualifications for all persons participating in the process of inspection and testing of work equipment, and for occupational safety experts and data on passed professional exam
11. date of commencement and end of examination and examination
12. information on the manufacturer’s instructions for the use and maintenance of work equipment and on other documentation used during the inspection and testing
13. methods, procedures and standards relating to inspections and tests and the measuring and test equipment used in inspections and tests
14. findings on the results of inspections and tests taking into account the maintenance documentation for work equipment
15. a concluding assessment that the results of inspections and tests of work equipment meet safety and health requirements or a description of deficiencies that do not meet the prescribed safety and health requirements with a proposal for measures to remedy the deficiencies; and
16. an indication of the prescribed time limit for the next examination and examination.
(2) Where the findings of other authorised testers and/or laboratories and work equipment maintainers are necessary to assess the fulfilment of safety and health requirements for certain parts of work equipment (for example, pressure equipment equipment, load-bearing ropes and other safety components of work equipment), then the findings on those inspections and tests and conclusions thereof are mandatory part of the inspection and testing records of work equipment.
(3) If more than one person participated in the examination and examination, each of them shall be signed by hand behind the data on the examination and the examination that it has carried out.
(4) The minutes shall be signed by hand by all persons who have carried out the examination and examination.
(5) The concluding assessment of the minutes shall be signed by a person of an authorised employer or an authorized person who meets the prescribed conditions for obtaining authorization, according to the regulation on authorizations for occupational safety.
(6) The minutes referred to in paragraph 1. this Article shall not be considered to be a conformity assessment document for work equipment when it is placed on the market or put into service.
Article 11
Notwithstanding the provisions of Article 7. Of this Ordinance, the employer is obliged to provide a visual inspection of the application of safety and health requirements on the same day before using work equipment.
PART FIVE
TRANSITIONAL AND FINAL PROVISIONS
Article 12
An authorised person who has been authorised to test work equipment shall comply with the provisions of this Regulation within 6 months from the date of its entry into force.
Article 13
(1) On the day of entry into force of this Regulation, the Ordinance on the list of machines and devices with increased hazards (“Official Gazette”, No. 47/02) shall cease to be valid.
(2) On the date of entry into force of this Regulation, Articles 14, 16, 17, 18 shall lapse, 19. and 20. Ordinance on testing the working environment and machines and devices with increased hazards (“Official Gazette”, no. 114/02, 131/02 and 126/03) and the test certificate form – SU.
Article 14
This Regulation shall enter into force on the eighth day following its publication in the “Official Gazette”.

REGULATIONS ON INSPECTION AND TESTING OF WORK EQUIPMENT
PART ONE
GENERAL PROVISIONS
Article 1.
(1) This Ordinance establishes the performance of inspections and tests of work equipment, the deadlines of inspections and tests, and the content and manner of issuing records of inspection and testing of work equipment.
(2) Inspection and testing of work equipment refers to work equipment consisting of machinery and appliances, installations and means of transporting and transporting goods under the regulation on safety and health in the use of work equipment.

Article 2.
For the purposes of this Regulation, it shall be deemed to be:

(2) Examination is any other operation in a procedure which cannot be determined by the examination referred to in subparagraph 1. this Article, which is necessary for the establishment of certain safety and health requirements and is carried out using measuring and testing equipment.
Article 3.
(1) The provisions of this Regulation shall not apply to work equipment consisting of electrical and electronic products covered by the regulation on electrical equipment intended for use within certain voltage limits:
1. household appliances intended for use in the household
2. Audio and video equipment
3. Information technology equipment
4. Common office machines
5. low-voltage switching and control devices and
6. Electric motors.
(2) The provisions of this Regulation do not apply to manual work equipment (tools) and to scaffolding and other means of occasional work at a height for which inspections are carried out according to special regulations.
PART TWO
SPECIFICATION
Article 4.
Authorised persons may carry out inspections and tests of work equipment referred to in the Article Item 1 2. of this Ordinance if they have an authorization in accordance with the provisions of the regulations on authorizations for occupational safety and if they meet the technical requirements prescribed by this Ordinance.
Article 5.
(1) With the authorisation issued under Article 4. An authorized person shall own the measuring and test equipment listed in the Annex which is an integral part of this Regulation.
(2) In addition to the measuring and test equipment listed in the Annex to this Regulation, an authorized person may also have additional measuring and test equipment for specific tests owned or under a lease agreement.
Article 6.
(1) Measuring and test equipment referred to in Article 5. this Regulation must be kept and maintained in the manner indicated in the instructions of the manufacturer of the measuring and test equipment.
(2) Documentation shall be kept on the measurement and test equipment, which shall contain the following information:
– name of measuring and testing equipment
– manufacturer name
– type, model and serial number
– year of production
– year of putting into service
– date of last calibration and
– proof of ownership or lease (for accessories).
(3) The measuring and test equipment referred to in the Annex to this Regulation for which there is an obligation to calibrate, shall be calibrated in the manner and within the deadlines set by the regulations in metrology, i.e. according to the recommendation of the manufacturer.
PART THREE
DEADLINES FOR EXAMINATIONS AND EXAMINATIONS
Article 7.

(4) The minutes shall be signed by hand by all persons who have carried out the examination and examination.
(5) The concluding assessment of the minutes shall be signed by a person of an authorised employer or an authorized person who meets the prescribed conditions for obtaining authorization, according to the regulation on authorizations for occupational safety.
(6) The minutes referred to in paragraph 1. this Article shall not be considered to be a conformity assessment document for work equipment when it is placed on the market or put into service.
Article 11
Notwithstanding the provisions of Article 7. Of this Ordinance, the employer is obliged to provide a visual inspection of the application of safety and health requirements on the same day before using work equipment.
PART FIVE
TRANSITIONAL AND FINAL PROVISIONS
Article 12
An authorised person who has been authorised to test work equipment shall comply with the provisions of this Regulation within 6 months from the date of its entry into force.
Article 13
(1) On the day of entry into force of this Regulation, the Ordinance on the list of machines and devices with increased hazards (“Official Gazette”, No. 47/02) shall cease to be valid.
(2) On the date of entry into force of this Regulation, Articles 14, 16, 17, 18 shall lapse, 19. and 20. Ordinance on testing the working environment and machines and devices with increased hazards (“Official Gazette”, no. 114/02, 131/02 and 126/03) and the test certificate form – SU.
Article 14
This Regulation shall enter into force on the eighth day following its publication in the “Official Gazette”.
