1. April 2020.ORDINANCE ON CHECKING THE CORRECTNESS OF STABLE FIRE PROTECTION SYSTEMS
I. BASIC PROVISIONS
Article 1.
This Ordinance prescribes the conditions for granting authorization to perform checks of the correctness and functionality (hereinafter: correctness) of the performed stable systems, devices and installations for fire detection, alarm and extinguishing, detection and notification of the presence of flammable gases and vapors and prevention of fire spread (hereinafter: systems), as well as the method of verifying their correctness.
II. CONCEPTS AND DEFINITIONS
Article 2.
Some of the terms in this Regulation have the following meaning:
– a fire detection and alarm system is a set of elements, functionally connected and non-transferable (automatic and manual fire detectors, fire alarm switchboards, fire signaling devices, power supplies, etc.) used for detecting and reporting fires in a pre-selected area. They can operate alone or in conjunction with a fire extinguishing system and protective devices and installations to prevent the spread of fire and the formation of explosions;
– a fire extinguishing system is a set of elements, functionally connected and non-transferable (water, foam, powder, gas extinguisher systems, etc.) used for firefighting. They can operate alone or together with a fire alarm system and protective devices and installations to prevent the spread of fire and the formation of explosions;
– a system for detecting and reporting the presence of flammable gases and vapors is a set of elements, functionally connected and non-transferable (measuring head, switchboard, signaling devices, power supply, etc.) used to detect and report the presence of flammable gases and vapors in a pre-selected space. They can operate alone or in conjunction with devices and installations to prevent leakage of dangerous concentrations of flammable gases and vapours;
– fire prevention devices and installations are a set of elements, functionally connected and non-transferable (fire dampers, fire doors with automatic closing device, smoke and heat dissipation devices generated by fire, etc.) used to prevent the formation and spread of fire. They may operate alone or in conjunction with a fire alarm and/or firefighting system;
– system elements are the individual parts of the system that enable its functional operation;
– means of the system are substances that are individually or in combination applied to a fire to extinguish it;
– the first test is a check of the correctness of the system that is carried out before putting into service a newly built or reconstructed system;
– periodic testing is a system check carried out periodically, at prescribed intervals after the first test;
– odobrena project documentation the project documentation on the basis of which the construction or reconstruction of the system has been approved in accordance with the applicable regulations governing the area of construction, and exceptionally, for existing systems for which such documentation does not exist and / or is not obtained, the detailed design was made and certified by the authorized designer, or the project of the as-built state with the positive opinion of the designer, made and certified by the authorized designer.
III. CHECKING THE CORRECTNESS OF THE SYSTEM
Article 3.
The correctness of the system is checked by the first and periodic tests.
Article 4.
The first testing of the system is carried out by legal entities authorized by the Ministry of the Interior (hereinafter: the Ministry) to perform tasks of testing the correctness of the system, which have not produced or reconstructed, imported, designed, installed or supervised the installation or reconstruction of the system or its elements, i.e. they are not the owners or users of the system.
Periodic system testing is performed by legal entities authorized by the Ministry to perform tasks of testing the correctness of the system.
Exceptionally, periodic testing of the system may also be carried out by a legal person that owns or is a user of the system or has produced or imported it, with the authorization of the Ministry.
Article 5.
Legal entities that perform system validation to third parties must be registered to perform the tasks of testing the correctness of the system.
Article 6.
Authorisation to verify the correctness referred to in Article 4 item 1. and 2 of this Regulation is given for the performance of tasks of checking the correctness of stable fire alarm and extinguishing systems (including devices and installations for the prevention of the occurrence and spread of fires and explosions) and/or stable systems for reporting the presence of flammable gases and vapours, to legal persons fulfilling the conditions prescribed by this Regulation.
Authorization to verify the correctness referred to in the article 4. paragraph 3 this Ordinance is given for performing the tasks of checking the correctness of certain systems to a legal person who meets the conditions prescribed by these Regulations, and is the owner or user of that system or has produced or imported it.
Article 7.
The application for the issuance of authorization to perform the tasks of checking the correctness of the system shall be submitted to the Ministry.
With the request referred to in paragraph 1. This article is attached to:
– extract from the register of commercial courts,
– list of names and surnames and OIB persons for performing the tasks for which authorization is requested and documents proving the direction and level of their education,
– documents proving employment with persons for the performance of the tasks for which the authorisation is requested,
– documents on passing the professional exam for performing the tasks of testing the system for persons for performing tasks for which authorization is requested;
– a list of the equipment necessary to carry out the tasks for which authorisation is requested pursuant to Article 10. in this Regulation, with the above inventory numbers,
– certificate of paid administrative fee, according to a special regulation.
Article 8.
A legal person to whom the authorization from this Regulation has been issued shall inform the Ministry of any change of the conditions on the basis of which the authorization to perform the tasks of checking the correctness of the system was issued within 15 days from the date of the change.
The application for the issuance of authorization to perform the tasks of checking the correctness of the system will be refused or the issued authorization to be annulled, to a legal person who does not meet or has ceased to meet the conditions prescribed by these Regulations.
The Ministry shall keep records of the issued authorizations from this Regulation.
Article 9.
The correctness check is carried out for the following systems:
– fire detection and alarm system;
– fire extinguishing system with gas agents;
– foam fire extinguishing system;
– water fire extinguishing system;
– water fog fire extinguishing system;
– powder fire extinguishing system;
– a system for detecting and reporting the presence of flammable gases and vapors;
– hydrant network;
– devices and installations to prevent the formation and spread of fires and explosions.
IV. SPECIAL TECHNICAL CONDITIONS
Article 10
Equipment necessary to carry out a check on the correctness of the system referred to in Article 9. This rule is:
– devices for activating all types of fire detectors (smoke, thermal, flame, etc.) with a calibrated output characteristic;
– universal measuring instrument;
– a device for measuring the electrical resistance of insulation;
– a device for measuring the capacity of a battery;
– means of connection (2 pcs.);
– shut-off clock;
– measuring tape (25–50 m);
– movable measure;
– sound gauge (0 – 120 dB);
– thermometer (-20 to +60 °C);
– hygrometer;
– airflow speed meter (up to 20 m/s);
– pressure gauges of appropriate measuring ranges with a minimum diameter of 100 mm and an accuracy class of 1.6 or less;
– steel three-meter;
– device for determining the slope of pipelines;
– various connections and taps for installing pressure gauges on the pipeline;
– wrenches for fire clutches;
– a set for determining the flow of water;
– standard tool kit;
– refractometer per Abbe (refraction area 1.3330 – 1.3723);
– containers for taking foam samples;
– slopes for capturing foam samples;
– stand for holding foam samples;
– balances of prescribed accuracy;
– compressor for overpressure min. 150 kPa;
– pump overpressure min. 10 MPa;
– cylinders with test gases (with technical specification) methane, propane, butane and hydrogen at concentrations of 20% and 40% DGE respectively;
– test gas pressure reducer;
– adapter for measuring head with associated pipes and
– other equipment necessary to determine the correctness of the system.
In the case referred to in Article 4. item 3 The appropriate equipment referred to in paragraph 1 is required. this article depends on the type of system whose correctness is being verified.
Article 11
Equipment referred to in Article 10 this Regulation must be marked with the corresponding inventory number and a register (inventory booklets/sheets) must be kept there.
Article 12
Equipment for checking the correctness of derivative systems subject to the provisions of the regulations on the compliance with metrological requirements shall have an appropriate document proving that it has been periodically inspected and moderate.
V. PROCEDURE FOR CHECKING THE CORRECTNESS OF THE SYSTEM
Article 13
The procedure for checking the correctness of the system, unless otherwise specified by a special regulation, consists of:
– review of approved project documentation,
– an overview of the as-built state in relation to the projected state,
– examination of documents on the usability of certain elements of the system prescribed by special regulations as well as documents on conducted tests prescribed by special regulations (e.g. pressure tests),
– checking the state of the system asset and the state and correctness of the operation of certain elements of the system,
– checking the correctness of interconnections of individual elements of the system (connectivity, tightness, passability, etc.),
– checking the correctness of the main and auxiliary sources of power supply to the system with propulsion power,
– checking the correctoperation of parts of the system operating in conjunction with other systems,
– verification of the sequence of operations when activating the system including the possibility of blocking,
– checking labels and indications and signalling of the system state including the fault state,
– measuring the performance characteristics of the system (time, quantity, flows, concentrations, quality, physical properties, signal strength, etc.)
– verification of manual and automatic activation of the system by simulating an actual event,
– checking the correctoperation of the system as a whole,
– other tests and checks necessary to determine the correctness of the system.
Checking the correctness of the system is carried out in accordance with the regulations and standards relating to the system being checked.
Article 14
Direct verification of the correctness of the system in an authorized legal person may be carried out only by persons of the profession who is necessary for checking the correctness of the system and who comply with the provisions of this Regulation.
Ancillary tasks when checking the correctness of the system may be performed by other persons who comply with the provisions of this Regulation.
Article 15
A test record shall be drawn up on the completed system check, containing:
– the record number and date of the minutes and the name of the legal person who carried out the examination,
– the number of authorisations of the Ministry on the basis of which the examination is carried out,
– name, surname, level of education and profession of the persons who carried out the examination,
– the date of the test carried out,
– number, date and name of the system project documentation maker,
– the number, date and name of the act approving the design documentation of the system,
– the name and description of the derived system that was tested,
– the regulations applied to the testing of the system,
– data on used equipment and measuring instruments,
– description and results of the tests,
– deviations from the approved design documentation with an assessment of the impact of deviations on the functionality of the system and statements of the system designer and the main designer (if any),
– assessment of the correctness of the system,
– other (observations, notes, etc.),
– signature of the persons who carried out the examination,
– signature of the responsible person of the owner or user of the system,
– certification by the seal and signature of the responsible person in the legal person who carried out the examination.
Minutes referred to in paragraph 1. this Article containing an unsatisfactory assessment of the correctness of the system is obliged to submit to the competent inspectorate of internal affairs of the police administration within 7 days from the date of the examination.
YOU. ASSESSMENT OF THE CORRECTNESS OF THE SYSTEM AND ISSUANCE OF CERTIFICATES
Article 16
The system shall be assessed as correct if it satisfies the conditions laid down in Title V of this Regulation, on which a certificate of system correctness shall be issued.
Article 17
If there are differences between the approved design documentation and the as-built state of the system, the persons performing the test are obliged to assess whether the differences affect the functionality of the system.
If it is assessed that the differences between the approved design documentation and the as-built state of the system do not affect the functionality of the system, about which there must be a written statement of the system designer and the main designer of the building (if any), a certificate of correctness of the system may be issued.
Article 18
The certificate of correctness of the system contains:
– the name of the legal entity that carried out the correctness check,
– the number of the certificate and the date of its issuance,
– the number of the Ministry’s authorization on the basis of which the correctness check was carried out,
– the record number and date of the test minutes,
– the name of the system for which the certificate is issued,
– certification by seal and signature of the responsible person in the legal person who carried out the correctness check.
Article 19
The legal entity that has carried out the check of the correctness of the system and the owner or user of the system are obliged to store and keep the records of periodic testing and certificates of system correctness upon their issuance until the next inspection, and the record of the first test and the certificate of correctness of the system from the first system test are obliged to store and keep permanently.
VII. HUMAN RESOURCES NEEDED TO PERFORM SYSTEM TESTING
Article 20
Legal person performing the tasks referred to in Article 4 item 1. and 2 of this Regulation, she is obliged to have in permanent employment at least one person mechanical, electrical and chemical or fire protection profession with completed undergraduate university study or professional study for a period of at least three years and one person of technical profession of at least secondary education.
Article 21
Legal person performing the tasks referred to in Article 4 item 1. and 2 of this Regulation only on stable systems for detecting and reporting the presence of flammable gases and vapours is required to have in permanent employment at least one person of mechanical or electrical engineering profession with a completed undergraduate university study or professional study for a period of at least three years and one person of technical profession of at least secondary education.
Article 22
Legal entity performing the tasks referred to in the article 4. paragraph 3 is obliged to have at least one person with completed undergraduate university study or professional study for a period of at least three years, the profession necessary to verify the correctness of the system specified in the authorization and one person of technical profession of at least secondary education.
VIII. PROFESSIONAL EXAM
Article 23
Persons referred to in Article 20. by 22. this Ordinance must have passed a professional exam to check the correctness of stable fire protection systems according to the program and in the manner prescribed by this Regulation (hereinafter: the exam).
The exam program is printed with this Regulations and is an integral part of it.
Article 24
The exam is taken in writing.
Article 25
Passing the exam is done before an examination committee appointed by the Minister of the Interior (hereinafter referred to as the Minister).
The examination committee consists of a chairperson and four members who have alternates.
Persons who have completed a graduate university study programme or an integrated undergraduate and graduate university study may be appointed to the examination committee.
Officials of the Ministry and persons from other institutions engaged in fire protection are appointed to the examination committee.
The decision on the appointment of the examination committee determines which subjects from the Professional Exam Program will be examined by the president and members of the committee.
A secretary shall be appointed to perform the administrative tasks of the examination committee.
Article 26
The application for the exam is submitted to the Ministry and contains:
– request for the exam,
– name and surname and date, place of birth and OIB of the candidate citizens,
– original or certified copy of the document on the achieved level of professional qualification,
– proof of paid costs of conducting the exam.
Article 27
The examination committee determines whether the candidate meets the requirements for taking the exam and issues a decision on this.
The decision, which approves the passing of the exam, determines the place and time of passing the exam and the obligation to pay the costs of conducting the exam.
The candidate who has been approved to take the exam must be informed of the date of taking the exam no later than 15 days before the deadline set for taking the exam.
Article 28
The candidate may withdraw or postpone the exam, but must notify the examination committee in writing at least 2 days before the date set for passing the exam.
Candidate stipulated within the period referred to in paragraph 1. this article postponed the exam or has given up taking the exam, the paid costs of the first exam may be considered payment for the next exam period.
Admission to the exam or the continuation of the initiated exam may be postponed, at the request of the candidate, due to illness or other justified reasons, as decided by the examination committee.
If the candidate does not take the professional exam without a justified reason or withdraws from the exam already started, it will be considered that he has not passed the exam.
Article 29
The candidate’s success in the exam is assessed by a grade: “passed” or “failed.” The candidate is assessed as “passed” if he has satisfied the answers in all subjects.
Article 30
A candidate who does not meet the exam can register for the makeup exam within 30 days from the date of passing the exam.
Article 31
On the course of the exam, a record is kept with information about the members of the committee the name and surname of the candidate, the date of the examination, the questions asked to the candidate and the evaluation of the committee on the success of the candidate.
The minutes are kept by the secretary of the examination committee and signed by the members of the committee present for the exam.
Article 32
The Ministry keeps records of candidates who have taken the exam in accordance with a special regulation.
Article 33
Candidates who have passed the professional exam are issued a certificate of passing the exam, signed by the Minister of the Interior or the person authorized by him and the chairman of the commission.
Article 34
Employees of the mechanical engineering profession take the exam in the subject under points 1, 2, and 3. This is the story of The Indo 1. and 2nd point 4. and 5. Professional exam program.
Employees of the electrical engineering profession take the exam in the subject under item 1, 3, 5. that material from the indent 1. and 2nd point 2nd and 4th. Professional Exam Program
Employees of the chemical profession or fire protection take the exam in the subject under item 1, 3, 4 and the material from the indent 1. and 2nd point 2nd and 5th. Professional exam program.
Article 35
The president, members of the examination committee and the secretary may be entitled to compensation for the work in the commission, in accordance with the decision of the minister.
The costs of conducting the exam and the amount of compensation referred to in paragraph 1. This article is determined by the Minister by a solution.
The costs of conducting the exam shall be borne by the candidate or legal entity that referred the candidate to the exam.
IX. TRANSITIONAL AND FINAL PROVISIONS
Article 36
Persons who have passed the professional exam according to the Ordinance on the program and method of passing the professional exam for testing the fire alarm and extinguishing system (“Official Gazette” no. 35/94 and 55/94.) until the date of entry into force of this Regulation, they do not have to take a professional exam in accordance with the provisions of these Regulations.
Article 37
With the entry into force of these Regulations, the following shall cease to be valid:
– Ordinance on the conditions for testing stable fire alarm and extinguishing systems (“Official Gazette” no. 67/96 and 41/2003);
– Ordinance on the program and manner of passing the professional exam for conducting the tasks of testing the fire alarm and extinguishing system (“Official Gazette” no. 35/94 and 55/94).
Article 38
This Regulation shall enter into force on the eighth day following its publication in the “Official Gazette”.

PROFESSIONAL EXAM PROGRAM
The professional exam program for performing the tasks of checking the correctness and functionality of the performed stable systems, devices and installations for fire detection, fire alarm and extinguishing, detection and reporting of the presence of flammable gases and vapors and preventing the spread of fire (hereinafter: the system) includes the following items:
1. Basics of legislation, devices and installations for preventing the spread of fire
It includes knowledge and application of regulations relating to:
– system building procedures,
– types of systems and system correctness tests,
– making elements of the system on the market and/or available,
– maintenance and testing of system elements,
– authorization to perform tasks of checking the correctness of the system,
– the method of verification and the equipment necessary to carry out the check of the correctness of the system,
– assessment of the correctness and document ation of the correctness of the system,
– criminal liability,
and knowledge and application of regulations and adopted technical practices, as well as working principles, methods and procedures of testing the functionality of devices and installations to prevent the spread of fire.
2. Stable water, water fog and water vapor extinguishing systems
Includes knowledge of the following content:
– knowledge of regulations and adopted technical practices for systems;
– principles of operation of elements and the whole system;
– equipment and measuring devices for testing as well as the principle of their operation;
– methods and procedures for examining the functionality of those systems.
3. Stable gas extinguishing systems
Includes knowledge of the following content:
– knowledge of the regulations and technical practices adopted for these systems:
– principles of operation of elements and the whole system;
– equipment and measuring devices for testing as well as the principle of their operation;
– methods and procedures for examining the functionality of those systems.
4. Stable foam and powder extinguishing systems
Includes knowledge of the following content:
– knowledge of the regulations and technical practices adopted for these systems;
– principles of operation of elements and the whole system;
– equipment and measuring devices for testing as well as the principle of their operation;
– methods and procedures for examining the functionality of those systems.
5. Stable systems for fire alarm and the presence of flammable gases and vapors
Includes knowledge of the following content
– knowledge of the regulations and technical practices adopted for these systems;
– principles of operation of elements and the whole system;
– equipment and measuring devices for testing as well as the principle of their operation;
– methods and procedures for examining the functionality of those systems.
